SEVEE CARE PVT. LTD. Informed Consent & Therapy Agreement

By selecting and using the services of SEVEE Care Pvt. Ltd. ("SEVEE CARE," "we," "us"), I, [Login ID / Full Name], confirm that I have read and understood the terms below, and give my informed consent to them. 1. Terminology For the purpose of this agreement, the terms "Therapist," "Psychologist," "Counselor," and "Consultant" are used interchangeably and refer to the service provider associated with SEVEE CARE. For consistency, "Therapist" is used throughout this document. This does not represent a claim of psychiatric licensure; SEVEE CARE's Therapists are qualified counseling professionals, and only those specifically identified as psychiatrists are authorized to diagnose or prescribe medication. 2. Location & Applicable Standards SEVEE CARE's Therapists are based in and qualified under the standards of India. Our services are provided under Indian professional and legal standards, regardless of where I am physically located at the time of a session. I understand that SEVEE CARE and its Therapists do not claim to be licensed or registered under the laws of any country other than India, and that I am responsible for satisfying myself that receiving counseling services from an India-based provider is appropriate and permissible under the laws of my own location. 3. Emergency Services I understand that SEVEE CARE does not provide emergency services and is not equipped to respond to life-threatening situations. In the event of a medical or psychiatric emergency, including suicidal ideation, intent to harm myself or others, or any immediate danger, I will contact my local emergency number (e.g., 112 in India, 911 in the US, 999 in the UK) or visit the nearest hospital immediately, rather than relying on SEVEE CARE. 4. Scope of Services & Referral SEVEE CARE's counseling services are intended for individuals capable of engaging in talk-based counseling. They are not designed or equipped to treat acute psychiatric conditions, including active psychosis, or situations requiring clinical psychiatric intervention. If, in my Therapist's professional judgment, my needs fall outside the scope of counseling services — including but not limited to signs of psychosis, severe cognitive impairment affecting my ability to meaningfully participate in or consent to counseling, or any condition requiring psychiatric evaluation — I understand that my Therapist may pause, decline, or discontinue sessions and refer me to a qualified psychiatrist or appropriate medical care. If, in my Therapist's reasonable judgment, I do not appear fully conscious or able to meaningfully participate in the session — whether due to alcohol, recreational drugs, or the effect of any medication, including prescribed medication — my Therapist may decline to begin or may discontinue the session. This applies regardless of whether the medication was taken as prescribed; the determining factor is my ability to meaningfully participate at the time of the session, not the legality or source of what was taken. Such a session will be treated as utilized, with no refund or credit issued. SEVEE CARE and my Therapist are not liable for outcomes arising from a condition that falls outside the scope of counseling services. 5. Membership & Therapist Allocation I understand I am enrolling in a SEVEE CARE membership, not with an individual Therapist. While my preferences will be considered, Therapist allocation depends on availability, scheduling, and membership validity. If my Therapist is unavailable, absent, or discontinues their association with SEVEE CARE, an alternate or proxy Therapist may be assigned, or I may be referred to a more suitable specialist. I may request a change of Therapist at any time, subject to availability. 6. Appointments & Sessions Sessions are by appointment only, conducted via video call, and last 45 minutes unless otherwise agreed. Sessions extending beyond 60 minutes may incur additional fees. If I am late, my Therapist will wait 15 minutes, after which the session will be marked as a no-show and the session fee will be forfeited. Missed time due to my own lateness will not be compensated or extended. 7. Rescheduling & No-Shows Sessions must be booked at least 6 hours in advance. Any changes to a booked session must also be made at least 6 hours before the scheduled time — after this window, the session will be treated as utilized and forfeited in full, and no-shows are treated the same way. All bookings and rescheduling can be managed directly through the members area of your account. A session can be rescheduled up to two times; beyond that, the session will be considered utilized. If you have a specific time preference for your sessions, we recommend booking as far in advance as possible, as your preferred slot may not be available closer to your intended session time. We aim to respond within 48 hours. I am responsible for tracking my own membership validity and session usage. If my Therapist initiates a cancellation, I am entitled to reschedule without any fee deduction or loss of session credit. 8. Confidentiality & Recording I consent to SEVEE CARE and my Therapist maintaining confidential session notes for professional purposes. Recording of sessions — audio, video, screen capture, or transcript — by either party is strictly prohibited without prior written consent. No information about me will be shared with any third party (including family members) without my explicit consent, except in the following circumstances: Risk of harm: Where my Therapist reasonably believes I am at risk of serious harm to myself, or pose a risk of serious harm to another person, including where I am assessed as unable to safeguard my own immediate safety; Legal requirement: Where disclosure is required by a court order, subpoena, or applicable law, including mandatory reporting obligations under the Protection of Children from Sexual Offences (POCSO) Act, 2012, where applicable; Supervision & training: Where my case is discussed with a clinical supervisor or peer group for professional supervision or training purposes, in which case identifying details will be limited to what is necessary and the same confidentiality obligation will apply to those involved. Except as set out above, my information will not be disclosed without my consent. 9. Client Conduct & Therapist Safety SEVEE CARE is committed to providing a safe, respectful environment for both clients and Therapists. Any form of sexual harassment, threatening behavior, verbal abuse, or conduct that causes a Therapist to reasonably feel unsafe will not be tolerated. In such circumstances, the Therapist may end the session immediately, without prior notice, and the session will be treated as completed with no refund. SEVEE CARE reserves the right to suspend or permanently terminate a client's access to its services, without refund, where such conduct occurs, and may bar the client from rebooking with any SEVEE CARE Therapist going forward. 10. Client Responsibility I understand that my mental and emotional well-being is ultimately my own responsibility. SEVEE CARE provides guidance and support but does not guarantee specific outcomes, and is not liable for personal decisions, life outcomes, or events occurring before, during, or after my engagement with SEVEE CARE. 11. Therapist/Consultant Relationship I acknowledge that my Therapist is engaged by SEVEE CARE as an independent, freelance professional and not as an employee. SEVEE CARE is not legally responsible for the individual clinical judgment, personal conduct, advice, or actions of my Therapist that fall outside SEVEE CARE's standard published policies and procedures, except as required by applicable law. Any breach of confidentiality, professional misconduct, or negligence by an individual Therapist is the responsibility of that Therapist, and SEVEE CARE will cooperate with any lawful inquiry into such conduct but does not assume liability for it. 12. Payments & Commitment Plans SEVEE CARE offers Commitment Plans of 1, 5, and 10 sessions, available with either an Associate or Expert Therapist, each with its own validity period as specified at the time of purchase. If you are unsure of your schedule or ongoing availability, you may choose a single-session (1) Commitment Plan, which must be used within 7 days of purchase. All payments for Commitment Plans are non-refundable, and SEVEE CARE does not offer cancellations. You may reschedule a session in accordance with Clause 7, or book a new slot, but sessions cannot be cancelled for a refund or credit. You are responsible for tracking and utilizing your sessions within the applicable validity period; unused sessions are forfeited once the validity period lapses. 13. Grievances If you have any concern, complaint, or grievance regarding your sessions, your Therapist, or SEVEE CARE's services, you may raise it through our designated grievance channel, details of which are available on our website, or by contacting our Grievance Officer at connect@sevee.care. We aim to acknowledge grievances within 48 hours and work toward a resolution in a timely and transparent manner. 14. Governing Law This agreement is governed by the laws of India, with courts/arbitration in Ahmedabad, Gujarat, India having jurisdiction, subject to any non-waivable consumer protection rights under the laws of my country of residence. 15. Acknowledgment I, [Login ID], confirm that I am providing this consent voluntarily, while of sound mind and in a fit mental state to understand and agree to these terms, and I accept this agreement by continuing to use SEVEE CARE's services.
