Please read these Terms of Use ("Terms") before availing any of our services. "You," "your," and "user" refer to an individual using our services. These Terms govern your access to and use of services provided by SEVEE Care Pvt. Ltd. ("we," "our," "us") through www.sevee.care (the "Website") and any associated service. By using our services, you agree to be bound by these Terms.
1. Important Notice on Emergencies SEVEE Care Pvt. Ltd. is not an emergency service provider. Do not use this Service for emergency or life-threatening needs. In case of an emergency, contact your local emergency number immediately (e.g., 112 in India, 911 in the US, 999 in the UK) or visit the nearest hospital. If you are experiencing suicidal thoughts, thoughts of harming yourself or others, or are in immediate danger, seek in-person emergency help without delay. 2. Eligibility You must be at least 18 years old to use our services. Users under 18 require the consent of a parent or legal guardian before using our services. You agree to provide truthful, accurate information during registration, that you are of sound mind and legally capable of entering into this agreement, and to promptly update us of any changes to your information. 3. Account Creation and Responsibilities You must create an account with accurate information and keep your login credentials confidential. Notify us immediately if you suspect unauthorized use of your account. You are responsible for all activity under your account; SEVEE CARE is not liable for loss or damage arising from unauthorized use, except where caused by our own negligence. 4. Nature of Services and Terminology SEVEE Care provides access to counseling, therapy, and mental wellness support through qualified professionals. For accessibility, we use the terms "therapy," "therapist," "psychologist," "counseling," and "counselor" interchangeably across our website and communications; these refer to our qualified counseling professionals and do not represent a claim of psychiatric licensure unless a provider is specifically identified as a psychiatrist. Our services are not a substitute for face-to-face mental health care, psychiatric treatment, or medical advice, and do not include diagnosis except where explicitly provided by a qualified psychiatrist engaged for that purpose. You are encouraged to consult your primary healthcare provider before making decisions based on information provided through the Service. 5. Location & Applicable Standards SEVEE Care's Therapists are based in and qualified under the standards of India. Our services are provided under Indian professional and legal standards, regardless of where you are physically located at the time of a session. SEVEE Care and its Therapists do not claim to be licensed or registered under the laws of any country other than India. You are responsible for satisfying yourself that receiving counseling services from an India-based provider is appropriate and permissible under the laws of your own location. 6. Scope of Services Our services are intended for individuals capable of engaging in talk-based counseling and are not designed for acute psychiatric conditions, including active psychosis, or situations requiring psychiatric intervention. A Therapist may pause, decline, or discontinue a session, without refund, where a client's condition falls outside the scope of counseling services, or where a client does not appear able to meaningfully participate — including due to the effect of alcohol, drugs, or medication (whether or not prescribed). Full detail is set out in your Informed Consent & Therapy Agreement. 7. Payment and Commitment Plans SEVEE Care offers Commitment Plans of 1, 5, and 10 sessions, available with either an Associate or Expert Therapist, each with its own validity period specified at the time of purchase. A single-session (1) Commitment Plan must be used within 7 days of purchase. Fees and plan names may change without notice for future purchases; changes will not retroactively affect an active, already-paid Commitment Plan. Payments are processed through secure third-party payment gateways; you are responsible for keeping your payment information current. 8. Digital Content License Any digital products or content provided (including session access, self-help materials, or resources) are licensed to you for personal, non-commercial use only. This license is non-exclusive and non-transferable. You may not share, distribute, reproduce, or resell any SEVEE CARE content without our prior written consent. 9. Acceptable Use You agree not to engage in unlawful, harassing, defamatory, abusive, or otherwise harmful conduct, or to transmit inappropriate or harmful content through the Service. Attempting to gain unauthorized access to other accounts or systems connected to the Service is prohibited. Violation of these Terms may result in suspension or termination of your account and, where applicable, legal action. 10. Client Conduct & Therapist Safety SEVEE Care is committed to a safe, respectful environment for both clients and Therapists. Any form of sexual harassment, threatening behavior, verbal abuse, or conduct causing a Therapist to reasonably feel unsafe will not be tolerated. A Therapist may end a session immediately, without prior notice, in such circumstances; the session will be treated as completed with no refund. SEVEE Care reserves the right to suspend or permanently terminate a client's access, without refund, where such conduct occurs, and may bar the client from rebooking with any SEVEE Care Therapist going forward. 11. Recording Prohibition To protect the confidentiality of clients and mental health professionals, SEVEE Care strictly prohibits recording, storing, or sharing any session or communication obtained through our services — including audio, video, screen captures, or transcripts — without prior written consent from SEVEE Care and the participating professional. 12. Membership & Therapist Allocation Services are provided under a SEVEE Care membership, not tied to any individual Therapist. Therapist allocation depends on availability, scheduling, and membership validity; SEVEE Care may assign an alternate or proxy Therapist where necessary, or refer you to a more suitable specialist. Requests for a change of Therapist will be accommodated subject to availability. Bookings and rescheduling are managed through the members area of your account; further detail is set out in your Informed Consent & Therapy Agreement. 13. Medication and Prescriptions Where psychiatric services are offered, SEVEE Care complies with the Telemedicine Practice Guidelines, 2020 and the Drugs and Cosmetics Act, 1940. Schedule X drugs, narcotics, and other controlled substances requiring in-person monitoring are never prescribed online. Where a psychiatrist determines in-person consultation is required, you will be informed accordingly. SEVEE Care disclaims responsibility for errors or omissions by a psychiatrist or by a patient's own non-compliance, without prejudice to any statutory rights you may have. Prescription-related concerns can be raised with our Grievance Officer at connect@sevee.care. 14. Disclaimers Regarding Individual Team Members SEVEE Care is not liable for personal commitments, advice, guarantees, or promises made by individual counselors, therapists, or staff that are not part of our standard published terms and are not authorized in writing by SEVEE Care. Users should confirm any terms of service directly through our official channels. 15. Intellectual Property All content on the SEVEE Care website — text, graphics, logos, and software — is the property of SEVEE Care Pvt. Ltd. or its licensors. You may not reproduce, distribute, or otherwise use this content without our prior written consent. 16. Limitation of Liability The Service is provided "as is," without guarantee that it will be error-free or uninterrupted. To the fullest extent permitted by law, SEVEE Care is not liable for indirect, incidental, or consequential damages arising from your use of, or inability to use, the Service. Nothing in these Terms limits liability that cannot lawfully be excluded under applicable law. 17. Support & Response Times For queries, technical issues, or support requests, you may contact us by email at connect@sevee.care or WhatsApp at +91 97127 77330. We aim to respond within 48 hours. 18. Grievances If you have any concern, complaint, or grievance regarding your sessions, your Therapist, or SEVEE Care's services, you may raise it through our designated grievance channel, details of which are available on our website, or by contacting our Grievance Officer at connect@sevee.care. We aim to acknowledge grievances within 48 hours and work toward a resolution in a timely and transparent manner. 19. Arbitration and Dispute Resolution Any dispute arising from these Terms shall be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator mutually appointed by the parties, with English as the language of arbitration. By agreeing to these Terms, you agree to resolve disputes through arbitration rather than court proceedings, except that nothing here limits any non-waivable consumer protection rights available to you under the mandatory laws of your country of residence. 20. Governing Law These Terms are governed by the laws of India, with exclusive jurisdiction (subject to Clause 19) vested in the courts of Ahmedabad, Gujarat, India. 21. Termination We may suspend or terminate your account without prior notice if you violate these Terms or engage in unlawful activity. 22. Changes to These Terms We may modify these Terms at any time. Material changes will be notified via the website or email; continued use of the Service after changes take effect constitutes acceptance of the revised Terms. 23. Related Policies These Terms should be read together with our Privacy Policy, No Refund & No Cancellation Policy, and Informed Consent & Therapy Agreement, all available on our website and incorporated here by reference.
