Important Notice on Emergencies SEVEE Care Pvt. Ltd. is not an emergency service provider. DO NOT use this Service for emergency medical needs. In case of a medical emergency, you must contact your local emergency services immediately. In India, please dial 112 for emergency assistance. If you are feeling suicidal, have thoughts of harming yourself or others, or are facing any immediate danger, you must seek immediate in-person help by contacting a nearby hospital or emergency services. 2. Agreement and Eligibility:- Individual must be 18 years to old to avail or services. Users under the age of 18 are required to obtain consent from legal guardian or supervisor. (If you are under the age of 18, you are required to obtain consent from legal guardian). It is essential to provide truthful and accurate information during registration process. In case of any changes to information, please inform us to ensure accuracy. 3. Account Creation and Responsibilities To access the Service, you must create a user account by providing truthful and accurate information. Maintaining the confidentiality of your account details, including your password is crucial. Notify SEVEE CARE immediately if you suspect any unauthorized use of your account. You are solely responsible for all activities that occur under your account & SEVEE CARE will not be held responsible for any loss or damage arising from unauthorized use of your account. 4. Payment and Subscription By subscribing to our services, you agree to pay all fees and charges associated with use of the Service in accordance with the pricing details provided on our website. The fees for our services and the name of our services are subject to change without notice. Payments can be made through secure payment gateways, and you are responsible for maintaining valid and updated payment information in your account. 5. Acceptable Use/ Lawful use Users shall not engage in any activity that is unlawful, harassing, defamatory, abusive, or otherwise harmful. Additionally, transmitting, uploading, or sharing content that is inappropriate, offensive, or harmful through the Service is strictly prohibited. Attempt to gain unauthorized access to others’ accounts, servers, or systems connected to the Service is strictly prohibited and unlawful. Users shall not engage in any activity that is unlawful, harassing, defamatory, abusive, or otherwise harmful. Additionally, transmitting, uploading, or sharing content that is inappropriate, offensive, or harmful through the Service is strictly prohibited. Any violation of these terms may/can result in the immediate termination of your account and legal actions may be taken. 6. Providers and Medical Disclaimer SEVEE Care provides access to professional therapists, counselors, and mental health providers. While our Providers are trained professionals, the Service is not a substitute for face-to-face mental health care or medical advice. You are encouraged to consult your primary healthcare provider before making any decisions based on the information provided through the Service. 7. Arbitration and Dispute Resolution Any dispute arising out of or relating to the use of SEVEE Care’s services, including the breach, termination, or validity thereof, shall be resolved through binding arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, and any amendments thereto. The arbitration shall be conducted by a sole arbitrator appointed mutually by the parties. The language of arbitration shall be English. By agreeing to these Terms, you waive your right to initiate any legal proceedings in a court of law and consent to resolve disputes exclusively through arbitration as specified herein. 8. Intellectual Property All content available on the SEVEE Care website, including text, graphics, logos, and software, is the property of SEVEE Care Pvt. Ltd. or its licensors. You shall not reproduce, distribute, or otherwise use the content without the prior written consent of SEVEE Care. 9. Limitation of Liability SEVEE Care provides the Service on an "as is" basis and does not guarantee that the Service will be error-free or uninterrupted. SEVEE Care shall not be held liable for any indirect, incidental, or consequential damages arising out of your use or inability to use the Service. 10. Governing Law These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Ahmedabad, Gujarat, India. 11. Termination In case of unlawful activity or violation of any of the mentioned Terms & Services, SEVEE Care reserves the right to terminate your account or suspend your access to the Service at any time, without prior notice, if you violate these Terms or engage in unlawful activity. 12. Changes to Terms SEVEE Care reserves the right to modify these Terms at any time. You will be notified of any changes, and your continued use of the Service after such changes constitutes your acceptance of the revised Terms. 14. Recording Prohibition To ensure the confidentiality and privacy of both clients and mental health professionals, SEVEE Care Pvt. Ltd. strictly prohibits the recording, storing, or sharing of any sessions, communications, or content obtained through our services, including audio, video, or written interactions, without prior written consent from SEVEE Care Pvt. Ltd. and the participating mental health professional. This prohibition applies to any and all forms of recording, including but not limited to: Audio recordings Video recordings Screen captures Transcript saving 15. Disclaimers Regarding Services by Team Members SEVEE Care Pvt. Ltd. strives to ensure that all team members provide services that align with the professional standards of the platform. SEVEE Care Pvt. Ltd. shall not be held liable for any personal commitments, advice, guarantees, or promises made by counselors, therapists, or other staff unless authorized in writing by an official representative of the company. Any personal advice, guarantees, or representations made by individual team members, whether oral or written, that are not part of the standard terms outlined by SEVEE Care Pvt. Ltd., are made solely by the individual and do not bind the company. SEVEE Care Pvt. Ltd. does not assume liability for the actions, promises, or assurances made by its team members that go beyond the agreed services or are not endorsed by the company in writing. Users are encouraged to clarify all terms of service directly through authorized channels at SEVEE Care Pvt. Ltd. to ensure accurate information. 16. Medication Prescription and Limitation of Liability Policy for SEVEE Care Pvt. Ltd. Controlled substances, as mentioned below will never be prescribed in online sessions. SEVEE Care Pvt. Ltd. complies with the Telemedicine Practice Guidelines, 2020, and the Drugs and Cosmetics Act, 1940, regarding the prescription of medications. SEVEE Care and its psychiatrists never prescribe any medications classified as Schedule X drugs, narcotics, or other controlled substances online. These substances include but are not limited to: Narcotic pain relievers Anti-anxiety drugs (e.g., benzodiazepines) Psychotropic medications that require in-person consultation and monitoring. Consultation Requirements If a psychiatrist determines that a patient requires medication that cannot be legally prescribed through an online consultation, the patient will be informed to seek an in-person consultation with the psychiatrist or another qualified healthcare provider. Safe and Compliant Prescriptions SEVEE Care psychiatrists are authorized to prescribe medications only in accordance with Indian law and Telemedicine Practice Guidelines. Prescriptions shall be limited to drugs permitted under these guidelines only. A copy of prescription will be provided to patient. Disclaimer Regarding Responsibilities SEVEE Care Pvt. Ltd. disclaims all responsibility for any errors, omissions, or actions by the psychiatrist or the patient. This includes, but is not limited to: Any misdiagnosis or incorrect prescription issued by the psychiatrist. Any failure of the patient to provide accurate medical history or follow prescribed treatment. Non-compliance by the patient in using the prescribed medications as directed. SEVEE Care Pvt. Ltd. shall not be liable for any adverse outcomes arising from errors made by either the doctor or the patient. It is the responsibility of the psychiatrist to ensure correct diagnosis and treatment, and the patient to follow instructions provided by the doctor. Grievances Related to Prescriptions In case of any concerns regarding prescriptions or consultation outcomes, patients can contact SEVEE Care’s Grievance Officer at connect@sevee.care. However, SEVEE Care disclaims liability for any issues resulting from doctor-patient interactions or errors made during the treatment process.
